DHS ARMY—THE EMERGING POLICE STATE

AN OUT OF CONTROL Transportation Security Administration expanding its invasive authority beyond airports. “Freeze” drills. VIPR teams. The declared objective of a civilian security force that is just as powerful as the US military. Is it any wonder American citizens are increasingly of the belief that the federal government is plotting against them and the Department of Homeland Security, in violation of the Constitution,2 is in the throes of a power grab to create an alternative federal police force? As many see it, this move not only incorporates state and local law enforcement into the DHS fold but also seizes unconstitutional powers by usurping the sovereign rights granted by the Tenth Amendment to the states while shifting the balance of power toward an emerging police state.

Where do the fear and anxiety come from? Why is it that some Americans are convinced that heavily armed jackbooted thugs will break down doors to round up dissident citizens and unceremoniously haul them off to illegal indefinite detention in secret locations known only to shadowy agents of the government? What would make people believe that the president is creating his own private civilian army to rule the land? And why is it so many are willing to accept the much-bandied-about conspiracy theory that federally operated fusion centers are gulag-style concentration or reeducation camps in disguise, as we discussed in the previous chapter? Or, that the government has a fleet of killer drones watching their every move that is, without warning, ready to obliterate them, their loved ones, and their homes, which we cover in detail in the next chapter?

These are not idle questions dreamed up by a loony conspiracy-minded citizenry. There is, sadly, a lot more fact than fiction to support their fears. Since at least the 9/11 attacks, the federal government is largely to blame for allowing such wild rumors to endure. More recently, natural disasters like Hurricane Katrina in September 2005 and Hurricane Sandy in October 2012 shook peoples’ sense of security to the very core, as these storms not only forced families from their homes, some of which were completely destroyed or rendered uninhabitable, but also demonstrated how quickly life can turn from daily routine to total chaos. People are conflicted, afraid their government will not be there when it is needed—or fear that it will be there to completely uproot their lives.

Take for example the brief white paper, “Homeland Security and Intelligence: Next Steps in Evolving the Mission,” prepared by the Aspen Homeland Security Group, cochaired by former DHS chief Michael Chertoff, and presented in January 2012 to the House Permanent Select Committee on Intelligence. The Aspen Institute group recommended DHS evolve away from its terrorism-based mission and refine its focus to work with state, local, and private sector partners and use its tools to secure the borders and analyze travel, protect critical infrastructure, and prevent cyber intrusions by “emerging adversaries.
